Yorgen Fenech, the man suspected of being behind the murder of Daphne Caruana Galizia, cannot be charged with having the name ‘Yorgen’, a legal expert spoken to by Bis-Serjetà has confirmed.
Speculation has been rife in recent days that not only would police charge Fenech with murder, but that his name was also a criminal offence.
“Being a Maltese man called Yorgen does not go against Article 242 (1) of the Civil Code (chapter 16) and is therefore not a crime, unfortunately,” the expert said.
“Nor is taking a stereotypical old German name and changing the spelling. He could be called Gonter, Hilmut or Vulfgong and the police’s hands would still be tied. However, he would be arrested if he ever set foot in Germany,” he clarified.
The expert said that if the Maltese courts had to lock up every person with a ridiculous name, the authorities would need to build a new prison to house all the Shamalamalayahs, Cleavons and Neymars.
